I started on the road towards finding some solution to the awkward license that Beatpick.com created without my permission, for use of song in fox film, the x-files i want to believe.
The main problem is that EMI music publishing think they own part of the song and Beatpick did not license them in, ontop of that Beatpick decided to create a license that would give nothing for all the DVD pressing of the song to DVD. The song at the end of the film gets paid for mechanical rights (DVD pressings), yet i don’t. Its amazing Fox films in some instances collects for the use of my song being pressed to DVD through the rights organizations, for instances where Mechanical rights have to be paid by law. SESAM in france.
Anyway, I contacted the organization that Beatpick lists in their contract for arbitration, Music Industry Association in the UK. I assumed that Beatpick music must be a member. Anyway the organization contacted me back, to tell me that they deal in musical instruments. MIA contacted Beatpick and since then Beatpick have taken their name from their website. The name still exists in their contract though
I’m wondering if this is enough to make their contract not valid. The law is kind of specific, from some views. Now i have to go direct to the lawyer. As soon as i pay a lawyer, i have to start paying. Lawyers don’t work for free.
Free-culture labels, end up being not much better than any other aspect of the music industry, that is the ones with focus on bottom line profits, and no concern for what the artist wants. I like the creative commons licenses, as they allow people to share stuff. Yet if Beatpick is example of business models that start to arrive as a result of the license, its kind of ironic.
Community based projects where people want to share music, getting around laws built for corporations, the license works fine.

Hi Forum,
At the moment i’m exploring possibilities of making the tunes i make free in Europe to spaces that don’t have a licensing agreement with local rights organization for “live” performance.
Why did i join ASCAP, when my works were free? a song was used in a major film, rather than joining with an exclusive contract for use of works, i went with ASCAP. ASCAP and BMI contract are non-exclusive.
Anyway: Its possible to license what “you” create freely and be a member of ASCAP, however i don’t see that any creative commons license presented to ASCAP would be recognized (unless backed up in conjunction with the artist) with info ASCAP ask for.
Here is what ASCAP ask for from the artist..
“when performing your songs in an unlicensed venue send myself the following details: the name and address of the venue, the length of the license and the song titles included in the license.”
The problems with ASCAP for artists out of the US, i have found so far are.. ASCAP offer no legal advice.. If you want to collect all your royalties, you have to make a company, as the royalty is divided up 50 to writer and 50 to publisher. This is not the way the system is in Europe or Australia.
When artists make what they create free and don’t join ASCAP/BMI and what they create is used in a commercial context, a fee is being paid. Its a weird situation, sure if your works are not in the system then the rights organizations have no means to collect, yet if they are being used, how does that make the situation?
also: If you have a co-write partners that have made songs under exclusive conditions, it further complicates the situation. As its not just upto those co-writers, its also upto the rights organization, and also any publisher that they might be affiliated with.
Hope this post helps out somehow..
also.. note, when i say free, i mean free in the context as me being able to negotiate my public performance rights with-out a third party such as OSA, APRA, ASCAP, SABAM being involved. In the context of small tea house, a direct license works.

I watched the Tudors season 3 for “free” at BIOOKO cinema, sponsored by HBO cable channel. Its called an historical fiction at this link , i figured that though, although a lot seemed partly true. I watched the period of Henry the 8th. H8 re-wrote the lords pray, cut 2 of his 6 wives heads off, and also had his main minster executed, Thomas Cromwell. Created the Church of England, made himself head of that, in doing so dissolved the influence of the Catholic church.

My friend from Germany said that its not possible to have a festival of TV series (in theater), as film is licensed differently to that of TV, every part of the series would need a new release from all its creators, i figured that’s why the series was free. Maybe the cinema used a different license for this one off broadcast, regular public license, some as a pub/cafe, maybe? HBO logo was in the right hand corner of the screen, through-out the screening. anyway: I like the BIOOKO cinema, its got an upstairs that has standard seating, downstairs are different kinds of chairs scattered radomly, lounges style, beach chairs.
Anyway, to keep my blog active, i thought to write something about what i watch in the cinema, stops me getting so lazy, and gets me reading the wiki pages, or bits of them, at least.

On facebook they have a group saying that digital music is oil free. response:
facebook group link are they going to delete the post?
one thing that is not oil free is all the money spent on promotion of music via publishers and labels. the best thing you can do for the environment is not pay for content owned by any label or publisher and buy content put out by self publishers, that is not joined to rights organizations. so really its not true that digital music is oil free. if you don’t buy it its less oil free. yet even then maybe having that music helps that published artist sell product via use of that content. its all a scam and you label people know it in your heart. go plant a tree and be real.

response to mail thread about how to get free-culture to work.
The idea of being able to make a living through music without having a live performance aspect to the art is not so common for DIY artists. Also consider if the act is solo or with a band. Artist is in Europe, US or developing/ transforming country. So many variables, no one size fits all.
Free music distributor www.Jamendo.com has 5000 Albums on site, from April to July Jamendo made 3000 Euros for artists through advertising revenue, that was split with artists according to how much content was used. This is less than a euro an album, consider the amount of time that goes into creating that content. The contributor to the site also gets a load of banners when they visit the network. The fan has the option of giving a donation, yet few contribute. This is good distribution for the artist/band yet with no live show to go with the performance what to do ?

In the last weeks i have been performing tunes around Europe. In my down time I visited some non-profit places/spaces to look for more shows. What i found interesting was this: more than most of the content performed in these venues is owned by publishers & most of the revenue comes directly from the government to keep these spaces open. I found it slightly ironic that the public is paying to keep a venue open that is promoting published acts.
Most large towns and cities in central europe have free-culture spaces ( non-profit organizations that provide subsidized entertainment to the public). From what I understand the better ones work this way: they have a board of directors that is made up mostly by leaders within the community. These leaders decide what projects get approved and what ones don’t. Some of the spaces are old theaters that have been updated to bar/cafe/venue-theater. These spaces want to stay open and competitive within the community, almost all the acts/productions that they promote
